A recent Safeway class action claims that the grocer charges their Portland, Ore. customers a one percent surcharge unlawfully. The surcharge allegedly pays for a new clean energy tax that began in Portland at the beginning of the year. The tax applies to retailers who make over a certain amount in the U.S. and in Portland.Safeway will pay $20,000,000 into a fund (the "Settlement Fund"). The final payment amount will depend on the total number of valid and timely claims submitted by Settlement Class Members, but Class lawyers representing class action settlement members estimate the payout will be somewhere between $18.00 and $36.00.Safeway and Albertson's denied any wrongdoing but agreed to pay the settlement.
